Tribal Bill of Rights for the Yahcalo Ndigena Nation


Preamble
We, the people of the Yahcalo Ndigena Nation, recognizing the inherent dignity and worth of every individual, and affirming our commitment to justice, equality, and respect for cultural diversity, hereby establish this Tribal Bill of Rights to protect the fundamental rights and freedoms of all members of our Nation.

Article I: Right to Life and Security
Every member of the Yahcalo Ndigena Nation has the inherent right to life, liberty, and personal security. No member shall be deprived of their life or subjected to violence, abuse, or exploitation.

Article II: Right to Bear Arms
Every member has the right to bear arms in accordance with the laws of the Yahcalo Ndigena Nation for personal defense and the defense of their community.

Article III: Right to Establish a Tribal State Defense Force
Members have the right to establish and maintain a Tribal State Defense Force, subject to the laws and regulations of the Yahcalo Ndigena Nation.

Article IV: Right to Freedom of Faith and Spiritual Practice
Every member has the right to practice their faith, engage in spiritual ceremonies, and uphold their religious beliefs without interference.

Article V: Right to Self-Identify
Members have the right to self-identify in accordance with their personal, cultural, and ancestral heritage.

Article VI: Right to Peaceful Protest
Members have the right to engage in peaceful protest and assembly to express their views and advocate for their rights.

Article VII: Right to Freedom of Religion
Every member has the right to practice their religion freely and to change their religion or belief.

Article VIII: Right to Freedom of Culture
Every member has the right to express, maintain, and develop their cultural identity and heritage.

Article IX: Right to Freedom of Speech
Members have the right to express their opinions and ideas without fear of censorship or retaliation.

Article X: Right to Child Protection
Children shall be protected from abuse, neglect, and exploitation, and their rights shall be upheld and promoted.

Article XI: Right to Non-Discrimination
All members are entitled to equal protection and benefits under the law without discrimination on any grounds.

Article XII: Right of Persons with Disabilities
Members with disabilities have the right to full participation in all aspects of society, including reasonable accommodations to ensure their access to services and opportunities.

Article XIII: Right to Family and Marriage
Members have the right to form families, including polyamorous and monogamous unions, and to receive legal recognition for their relationships.

Article XIV: Right to Freedom of Movement
Every member has the right to move freely within the territory of the Yahcalo Ndigena Nation and to travel internationally with a Yahcalo Ndigena Nation passport.

Article XV: Right to Access Justice
Members have the right to fair and timely access to justice and legal representation.

Article XVI: Right to Political Participation
Every member has the right to participate in the political processes of the Yahcalo Ndigena Nation, including voting and running for office.

Article XVII: Right to Social Security
Members have the right to social security and access to welfare programs to ensure their well-being and economic stability.

Article XVIII: Right to Rest and Leisure
Every member has the right to rest, leisure, and recreation, including reasonable working hours and paid time off.

Article XIX: Right to Information
Members have the right to access information held by the Nation and its institutions, ensuring transparency and accountability.

Article XX: Right to Environmental Protection
Members have the right to a clean and healthy environment and to participate in decisions affecting their natural resources and ecosystems.

Article XXI: Right to Cultural Expression
Members have the right to express their cultural identity, traditions, and practices freely.

Article XXII: Right to Education
Every member has the right to quality education that respects and integrates their cultural heritage and promotes personal and communal development.

Article XXIII: Right to Health
Members have the right to access healthcare services and programs that promote their physical, mental, and emotional well-being.

Article XXIV: Right to Property
Members have the right to acquire, own, and use property, including land and resources, in accordance with the laws of the Yahcalo Ndigena Nation.

Article XXV: Right to Work
Every member has the right to seek employment, engage in productive work, and receive fair compensation.

Article XXVI: Right to Privacy
Members have the right to privacy in their personal, family, and community lives, free from unwarranted interference or surveillance.

Article XXVII: Right to Fair Trial
Members are entitled to fair treatment under the law and due process in legal proceedings, including the right to be heard, to appeal, and to seek justice.

Article XXVIII: Right to Freedom and Equality
All members are entitled to freedom and equality before the law and in all aspects of life within the Yahcalo Ndigena Nation.

Article XXIX: Right to Freedom of Expression and Assembly
Every member has the right to express their thoughts and beliefs and to assemble peacefully. 

Article XIII: Right to Due Process

  • Members are entitled to fair treatment under the law and due process in legal proceedings, including the right to be heard, to appeal, and to seek justice.

Article XIV: Right to Protection of Intellectual Property

  • Members have the right to protect their intellectual property, including cultural expressions, traditional knowledge, and innovations, ensuring their recognition and respect.

Article XV: Right to National Service and Participation in Development

  • Every member has the right to contribute to the development and defense of the Yahcalo Ndigena Nation through national service and community engagement.

Article XI: Right to Environmental Protection

  • Members have the right to a clean and healthy environment and to participate in decisions affecting the natural resources and ecosystems of their territories.

Article XII: Right to Cultural Heritage

  • Every member has the right to preserve, protect, and promote their cultural heritage, languages, traditions, and customs, contributing to the cultural diversity of the Yahcalo Ndigena Nation

Article X: Right to Social Welfare

  • Members have the right to access social welfare programs that support their basic needs, promote family stability, and enhance community resilience.

Article II: Right to Freedom of Faith and Culture

  • Every member has the right to practice their faith and culture freely, without interference or discrimination.
  • The Yahcalo Ndigena Faith, alongside the Trubian Culture and Yahcalo Ndigena Culture, shall be respected and upheld.

Article III: Right to Equality and Non-Discrimination

  • All members of the Yahcalo Ndigena Nation are entitled to equal protection under the law, regardless of gender, age, ancestry, ethnicity, or any other status.
  • Discrimination in any form is strictly prohibited.

Article IV: Right to Participation in Governance

  • Every member has the right to participate in the governance of the Yahcalo Ndigena Nation, including the right to vote, run for office, and engage in the decision-making processes of their Tribal State and the Nation.

Article V: Right to Privacy

  • Members have the right to privacy in their personal, family, and community lives, free from unwarranted interference or surveillance.

Article VI: Right to Education

  • Every member has the right to access quality education that respects and integrates their cultural heritage and promotes personal and communal development.

Article VII: Right to Health and Well-Being

  • Every member has the right to access healthcare services and programs that promote physical, mental, and emotional well-being.

Article VIII: Right to Property

  • Members have the right to acquire, own, and use property, including land and resources, in accordance with the laws of the Yahcalo Ndigena Nation.

Article IX: Right to Freedom of Expression

  • Every member has the right to express their thoughts, opinions, and beliefs freely, including the right to seek, receive, and impart information.

Ratified by Initial Nation Chief, Eli Keysar Shalit on the year 2024 of our Lord on the 13th day of October, This Bill of rights may be amended by Intial National Chief, or Supreme Tribal Council of Yahcalo Ndigena Nation
